Proclamation No. 1094/2018

A PROCLAMATION TO AMEND THE ADDIS ABABA CITY GOVERNMENT REVISED CHARTER PROCLAMATION

WHEREAS, it is provided for under Article 28 (1) of the Electoral Law of Ethiopia Amendment Proclamation No. 532/2007 (as amended), general election to the House of Peoples’ Representatives shall be conducted every five years;

WHEREAS, it is stipulated under Article 8 of Addis Ababa City Government Revised Charter Proclamation No. 361/2003 (as amended), election for the Councils at all levels of the City Government shall be conducted in accordance with the election laws of the country;

WHEREAS, it is found important to amend the law, unless election is conducted the Council shall not have the power to discharge it’s duties, as the term of Office of the Council expires on July 7 /2018;

WHEREAS, it is found important to retain the existing Council and the executive organs to discharge its duties until election is conducted;

WHEREAS, it is found important to incorporate a provision which allows appointment of competent Deputy Mayor either from the members of the Council or none members of the Council;

NOW,THEREFORE, in accordance with Article 49(2) and 55(1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:

  1. Short Title

This Proclamation may be cited as the “Addis Ababa City Government Revised Charter (amendment) Proclamation No. 1094/2018”.

  1. Amendments

The Revised Addis Ababa City Government Charter Proclamation No. 361/2003 (as amended) is hereby re-amended as follows:

1/ Paragraph (f) of sub-article (2) of Article 14 of the Proclamation is amended and replaced by the following new paragraph (f):

“f) elect, from among its members, the City Mayor;”

2/ Sub-article (1) of Article 15 of the Proclamation is amended as follows and the following new sub-article (2) and (7) is added:

“1/ The term of Office of the Council shall be five years; provided, however that; due to force majeure if it is not possible to conduct election at the end of the five years term, the House of Peoples Representatives may extend the election period. The Council shall have regular and extraordinary meetings and the regular meetings shall be held every two months.”

“2/ Without Prejudice to sub-article (1) of this article, When the House of peoples’ Representatives decides to extend of the election the City Council until the next election period, the existing City Council and the whole city Administration Shall be remain active until rearrangement is based on the new election.

“7/ When the term of Office of the Council is extended pursuant to sub-article (1) of this Article, the existing Addis Ababa City Government organs established by law shall continue to discharge their duties and responsibilities until election shall be held.”

3/ Sub-article (3) of Article 22 of the Proclamation is amended as follows:

“3/ The Deputy Mayor shall be appointed either from the members of the Council or non members of the Council, the term of Office of the Mayor shall be that of the Council provided the he may be removed from his post, prior to the end of such term, upon resignation, Suspension from Office of or termination of his membership in the Council, details thereof shall be set out by the internal regulation of the Council.”

  1. Effective Date

This Proclamation shall enter into force on the date of its approval 7th day of July by House of Peoples’ of Representatives. Done at Addis Ababa, 16th of the August 2018.
