Proclamation No. 1073/2018

A PROCLAMATION TO PROVIDE FOR THE AMENDMENT OF RAW HIDE AND SKIN MARKETING PROCLAMATION

Whereas, it has become necessary to amend the existing Raw Hides and Skins Marketing Proclamation No. 814/2013 to include raw hide and skin collectors in the market actors inorder to solve raw hide and skin quality and collecting problems so as to secure economic benefits of the country and people involved in the sector;

Now, therefore, in accordance with Article 55(1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:

1.  Short Title

This Proclamation may be cited as the “Raw Hides and Skins Marketing (amendment) Proclamation No. 1073/2018”.

2.  Amendment

The Proclamation to provide for Raw Hide and Skin Marketing No. 814/2013 is hereby amended as follows:

1/    Sub-articles (3) , (4) ,(8), (18),(19) and (20)  of Article 2 are deleted and replaced by the following new sub-articles (3), (4) , (8) ,(18),(19) and (20)  respectively:

“3/ ‘fresh hide or fresh skin’ means a fresh hide or fresh skin not treated with  salt, not dried by air and supplied within not more than six hours after slaughter of the animal;

 4/ ‘salt’ means a salt designated as chemical salt by the  Ethiopian Standards Agency for the treatment of raw hide and skin and not edible by human being and animals;

8/  ‘market actor’ includes producers, collectors, suppliers, traditional hides and skins processer’s, tanneries and transporters participating in hide and skins marketing;

18/         ‘certificate of competence’ means a certificate issued to a person who fulfills the requirements laid down under a directive issued by the appropriate organ to engage in the marketing of raw hides and skins business ;

19/         ‘Ministry’ mean Ministry of Livestock and Fishery Resource;

20/         ‘appropriate organ’ means, as the case may be, the Ministry or a Regional Organ authorized to administer the marketing process;

2/ The following new sub-articles (24), (25), (26) and (27) are  added after sub-article (23) of Article 2 of the Proclamation and the existing sub-article (24) is renumbered as sub-article (28) :

“24/       ‘raw hide and skin collector’ means a person who, registerd by the appropriate organ and collectes fresh raw hides and skins from producers by travelling in area of his registration and sells to traditional tanners and hides and skins suppliers at first level raw hides and skins market;”

25/ “store” means keeping raw hide and skin over the permitted amount and time in a preparation and storage place

26/ “standard” means raw hide and skin quality assurance set by Ethiopian Standard Agency.

27/ “individual producer” means a person who sell fresh raw hide or skin by giving slaughter service to private organization or  door to door slaughter service.

3/ The following new paragraphs (d to f) are added after paragraph (c) of Article 5(2):

“d)  individual producers and raw hide and skin collectors;

 e) raw hide and skin collectors and   traditional  raw hide and  skin tanners; and

 f) raw hide and skin collectors and suppliers;”   

4/ Sub-article (8) of Article 5 of the Proclamation is deleted;

5/  The following new sub article 10 is added after Article 9(9)  of the Proclamation:

ʺ10/ to work, prepare and administer in a manner not to pollute the environment according to other laws set for environmental protection;

6/  The following new sub article 8 is added after Article 11(7)  of the proclamation:

ʺ8/  to work, prepare and administer in a manner not to pollute the environment according to other laws set for environmental protection;

7/ The following new Articles 12 and 13 are added after Article 11 of the Proclamation and the existing provisions from Article 12 to Article 17 are renumbered as Article 14 to Article 19, respectively:

“12. Obligations of Raw Hides and Hkins Collectors

Any collector of raw hides and skins shall:

1/ work, prepare and administer in a manner not to pollute the environment according to other laws set for environmental protection

2/ buy fresh raw hides and skins only from individual producers;

3/ collect raw hides and skins with maintaining its quality;

4/ Show the appropriate organ, permission letter and allow visit of his raw hides and skins   collecting place when requested by the appropriate organ ;

5/ refrain from any activity which may ruin the country’s raw hides and skins quality and market; and

 6/    respect the provisions of this Proclamation, Regulation and Directives issued hereunder.”

“13.        Obligations of Traditional Raw Hide and Skin Tanners

Any traditional raw hide and skin tanner shall:

1/ work in a manner not to pollute the environment according to other laws set for environmental protection;

2/     have trade license from appropriate organ for his business;

3/ buy raw hides and skins only from producers or from collectors;

4/     not to store raw hides and skins;

5/     record the daily purchase and sales volume of raw hides and skins in quantity, grade and value and give such information to the appropriate organ when requested;

 6/    allow the appropriate organ, when requested, to visit his raw hides and skins tanning   place;

7/ refrain from any activity which may ruin the country’s raw hides and skins quality and market; and

8/ respect the provisions of this Proclamation, Regulation and Directives issued hereunder.”

8/ Sub-article (1) of Article 16 (as renumbered pursuant to sub-article (5) of this Article) of the Proclamation is deleted and replaced by the following new sub-article (1): 

“1/ Any person who involves in first level marketing of raw hides or skins with a person not permitted to participate at first level marketing shall be confiscated the raw hides and skins provided, however, that if it is conducted outside the production of house hold consumption, it shall, in addition be punishable with simple imprisonment not exceeding one year and with fine not exceeding Birr 15,000.”      

3.  Effective Date

This Proclamation shall enter into force on the date of publication in the Federal Negarit Gazette.
