PROCLAMATION No.1213 /2020

A PROCLAMATION TO AMEND THE MINING OPERATIONS PROCLAMATION

WHEREAS, it has become necessary to amend the Mining Operations Proclamation;

NOW, THERFORE, in accordance with Article 55 (1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:

1 Short Title This Proclamation may be cited as the “Mining Operations (Amendment) Proclamation No. 1213/2020.”

2. Amendment The Mining Operations Proclamation No. 678/2010 as amended by Proclamation No.816/2013 is hereby amended as follows:

1. The following new paragraphs (d) and (e) are added under Sub-Article (3) of Article 11 of the Proclamation:

“d) a non-citizen of Ethiopia, construction minerals excluding those used as raw material and dimension stones such as sand, aggregate, selected materials and others.” “

e) except a foreign investor who would like to engage in large scale placer mining in partnership with a domestic investor holding a minimum of 25% share, a foreign investor who would like to engage in any other placer mining operation.”

2. Article 51 of the Proclamation is deleted and replaced by the following new Article 51:

“1/ Any Ethiopian or Ethiopian Origin who wishes to engage in providing consultancy service in the mining sector may apply to the Ministry for a certificate of competence by paying the appropriate application fee and completing the appropriate form.

2/ Any person who wishes to engage in providing technical service such as drilling, laboratory or residue stockpile separating service in the mining sector may apply to the Ministry for a certificate of competence by paying the appropriate application fee and completing the appropriate form.

3/ Any person who wishes to engage in providing technical service in fieldwork such as health, camping and catering service in the mining sector may apply to the Ministry for a certificate of competence by paying the appropriate application fee and completing the appropriate form.

4/ The Ministry shall accept and register the application for certificate of competence if the requirements specified in Sub-Article (1), (2) and (3) of this Article are met.”

3. The following new Sub-Article (4) is added under Article 82 of the Proclamation:

“4. A mining license or mining agreement issued to a foreign investor or concluded with a foreign investor to mine construction minerals excluding those used as raw material and dimension stones such as sand, aggregate, selected materials and others, including placer mining operation prior to the coming into effect of this Proclamation shall continue in force for the remaining period of its validity. However, the renewal of the license or agreement upon expiry shall be made in accordance with the provisions of this Proclamation.”

3. Effective Date

This proclamation shall enter in to force on the date of publication in the Federal Negarit Gazette.
