COUNCIL OF MINISTERS REGULATION TO PROVIDE THE DEFINTION OF POWER, DUTIES AND ORGANZATION OF THE WATER DEVELOPMENT COMMISSION
This Regulation is issued by the Councils of Ministers pursuant to Article 5 and Article 34 of the Definition of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 1097/ 2018.
1. Short Title
This Regulation may be cited as the “Definition of Power, Duties and Organization of the Water Development Commission Council of Ministers Regulation No. 442/2018”
In this Regulation, unless the context otherwise requires:
1/ “Water Development” means the development of potable water and sanitation ;
2/ “Potable water” means water that meet the Ethiopian drinking water quality standards;
3/ “Sanitation service” means safe and sustainable collection, removal and management of domestic and institutional liquid wastes;
4/ “Sewage” means liquid effluents discharged from domestic, industrial and other sources;
5/ “Ministry” or “Minister” means the Ministry or the Minister of Water, Irrigation and Energy, respectively;
6/ “Regional State” means any State referred to under article 47 of the Constitution of the Federal Democratic Republic of Ethiopia and includes the Addis Ababa and Dire Dawa City Administration ;
7/ Any expression in the masculine gender includes the feminine.
3. Head Office
The Commission shall have its head office in Addis Ababa and may have branch offices elsewhere, as may be necessary.
The commission shall have the following objectives:
1/ create healthy and productive citizen and bring rapid and sustainable economic development by increasing the coverage of potable water supply, sanitation and hygiene through carrying out the study, design and construction of sustainable potable and reliable water supply and sanitation infrastructure;
2/ Improve the nation’s potable water supply and sanitation service management through implementation of improved water supply and sanitation service delivery system.
5. Power and Duties of the Commission
The commission shall have the following powers and duties:
1/ Coordinate and conduct potable water supply and sanitation infrastructure study and designs in rural and urban areas;
2/ Provide support to the regions for infrastructure development of potable water supply and sanitation services in urban and rural areas;
3/ Ensures potable water supply and sanitation development to be based on the principle of cost recovery and equitable use;
4/ Follow up and monitor potable water supply and sanitation infrastructure development projects study, design and construction financed by the federal government and loans and grants from abroad are in line with the national design quality standard;
5/ Prepare , disseminate and follow up the implementation of national potable water supply and sanitation study , design, construction and utility management criteria, guideline, standards and manual ;
6/ Develop, analyze, disseminate and update the national water supply and sanitation database system;
7/ Provide support to raise the potable water supply and sanitation infrastructure coverage;
8/ Secure additional financial resources from stakeholders, donors and development partners to potable water and sanitation works;
9/ In collaboration with appropriate stakeholders, studies quality standards that potable water shall have and submit to the ministry;
10/ Facilitate ways in which capacity building supports are given to service providers, consultants, contractors and private, governmental and non-governmental organizations involved with material providing in potable water supply and sanitation sector;
11/ Ensure the participation and benefits of women in the potable water supply and sanitation development;
12/ Ensures the benefits of groups that need special support in the potable water supply and sanitation development;
13/ Provide support to youth and private sector so that they can involve in the study design, construction, operation and maintenance as well as management of water supply and sanitation;
14/ Ensures access to potable water supply, particularly to communities and livestock in drought prone areas through promotion of climate resilient water supply strategy;
15/ set the relevant system and follow up mechanism to mitigate adverse environmental and social impacts of water supply and sanitation projects and promote recycling of treated waste water and resources recovery.
16/ Ensures the participation of beneficiary communities in the implementation of water supply and sanitation infrastructures;
17/ Create enabling ground for the reliable service provision of water supply and sanitation schemes through the utilization of feasible alternative renewable energy resources;
18/ Provide integrated professional support to regions that seek special support; in coordination with relevant stakeholders provide support for emergency potable water supply and sanitation services;
19/ Prepare long, medium and short term national plan for potable water supply and sanitation sector and follow up its implementation;
20/ Plan activities that enhance the implementation capacity of the sector; suggest policy ideas and implement when approved;
21/ own property, enter into contract, sue and be sued in its own name;
22/ Implement other necessary duties which are required to achieve its goals
6. Organization of the Commission
The Commission shall have:
1/ A Commissioner and Deputy Commissioners, to be appointed by the government ; and
2/ the necessary staff.
7. Power and Duties of the Commissioner
1/ The Commissioner shall be the chief executive officer of the Commission and shall direct and administer the activities of the Commission.
2/ without prejudice to sub-article (1) of this Article, the Commissioner shall;
a) exercise the power and duties of the commission specified under article 5 of this Regulation;
b) employ and administer employees of the Commission in accordance with the federal civil service laws;
c) prepare annual work plans and budgets of the Commission and implement the same upon approval;
d) effect payments in accordance with the approved budget and work program of the Commission;
f) represent the Commission in all its dealings with third parties;
g) submit to the Ministry performance and reports of the Commission.
3/ The Commissioner may delegate part of his powers and duties to other officers and employees of the Commission to the extent necessary for the effective performance of the activities of the Commission.
8. Power and Duties of Deputy Commissioner
The Deputy Commissioner shall have the following powers and duties:
1/ Assists the Commissioner in planning, organizing, directing and coordinating the activities of the commission;
2/ perform duties specifically assigned to him by the Commissioner;
3/ Act on behalf of the Commissioner on his absence.
The Commission’s budget shall be allocated by the Government.
10. Books of Accounts
1/ The Commission shall keep complete and accurate books of accounts.
2/ The book of accounts and financial documents of the Commission shall be audited annually by the Auditor General or an Auditor designated by him.
11. Effective Date
This Regulation shall come into force on this 14th day of November, 2018, approved by the Council of Ministers.
