REGULATION NO. 507/2022

COUNCIL OF MINISTERS REGULATION TO DETERMINE ORGANIZATION, POWER AND DUTIES OF ETHIOPIAN TECHNOLOGY AUTHORITY

This Regulation is issued by the Council of Ministers Pursuant to Article 58(2) of the Definition of Power and Duties of the Executive Organs Proclamation No. 1263/2021.

1.       SHORT TITLE

This Regulation may be cited as the “The Definition of Organization, Power and Duties of Ethiopian Technology Authority Regulation No. 507/2022”.

2. DEFINITION

In this Regulation unless the context otherwise requires:-

1/ “Accident” means any unintended event which may cause hazard and includes operating errors, apparatus failures or transportation risk or other calamities with respect to technology, the consequences or potential consequences of which are not trivial from the perspective of safety;

2/ “Activities” means the production, use, import and export of technologies for agricultural, industrial, research, education and training and medical purposes; the transport of technologies; the   sitting,       construction, commissioning, operation and decommissioning of facilities for peaceful purpose; technology waste management activities and site rehabilitation and also include the activities stated in this Regulation;

3/ “Aerospace technology” means the techniques, results, tools, and methods used by aerospace scientists for various tasks;

4/ “Authority” means the Ethiopian Technology Authority established in accordance with Article 58 Sub-Article of Proclamation No. 1263/2021;

“Chemical” means any chemical that is used for industrial, educational, training and research and induction purposes, excluding agro-chemicals and household pesticides;

6/ “Competent authority”  means Ministries and Authorities that includes Ministry of Innovation and Technology, Ministry of Industry, Ministry of Trade and Regional Integration, Ministry of Mines, Environmental Protection Authority, Ministry of Health, Ethiopian Customs Commission, Food and Drug Control Authority, Ethiopian Agriculture Authority, Ethiopian Construction Authority, Ethiopian Roads Administration, Ethiopian Communication Authority, Information Network Security Administration;

7/ “Electrical equipment” means a device designed for the generation, transformation,       transmission, distribution or utilization of electricity and containing or consisting of electrical or electronic components  or an operational whole consisting of such devices;

8/ “Electronics device” means a  component for controlling the flow of electrical currents for the purpose of information processing and system control excluding radiaton source medical devices used for medical purpose;

“Emerging technology” means a technology that includes nano technology, materials Science, artificial intelligence and the like fields that depend on new, existing or improved knowledge; can build greater capacity to compete for rapid development; can help register tangible and sustainable growth in economic, social and political sphere; have multifaceted purpose and increasing acceptance; and technologies that create opportunity in terms of solving existing and upcoming national or international problems;

10/ “Material Technology” means selection of materials with the properties that best meet the service requirements of a component as well as maintaining the performance of the materials over the operating life of the component by resisting corrosion, fatigue, temperature and other damaging events;

11/ “Machinery” means a technical unit or  a totality of units designated for transformation of energy, materials and information, consisting of mutually related components, out of which at least one can move;

12/ “Safety” means the protection of people, property and the environment against technological risk;

“Space material” means  objects designed and manufactured for use by aerospace, such as propulsion machines, telescopes, remote sensing technology equipment, transponders, satellite receiver antennas, space geodesy technology devices global positioning system(GPS) such as satellites, satellites spacecraft which includes UAVs and space technology equipment;

14/ “Technology” means Radiation and Nuclear, chemical, electronics and electric appliance, plant and machinery, material technology, Emerging technology, aerospace and space technologies;

15/ “Ministry” or “Minister” means the Ministry or Minister of Innovation and Technology respectively;

16/ “Person” means any natural or juridical body;

17/ Any expression in the masculine gender includes the feminine.

3. Objective

The objective of the Authority is to ensure the safety of the people, the environment and property from the harmful effect of technology.

4.    Scope of Application

This Regulation shall apply to radiation and nuclear; chemicals; plant and machinery; electrical and electronic equipment, material technology, emerging technology or in aerospace and space technology.

5.    Power and Duties of the Authority

The Authority shall have the following power and duties:-

1/ Conduct research on  activities supporting technological regulatory activities;

2/ Establish a system and develop requirements to regulate activities of each technology given to the Authority;

3/ Issue licenses and license grades for activities related to the technologies included in this Regulation;

4/ Collect service fees in accordance with the Regulation to be issued by the Council of Ministers; follows up the activities, renew, suspend and revoke licenses;

5/ Carryout inspection and take appropriate legal measures on licensees who violate the laws;

6/ Issue standards for regulated technologies; regulate      the implementation of mandatory standards;

7/ Establish an environmental monitoring system for chemicals that can be used for dual purpose;

8/ Establish procedures for enforcing and regulating the import and export of technologies or related practices in collaboration with the competent authority;

Formulate emergency preparedness and response plan for accidents involving technological risks and implement accordingly in collaboration with other competent authority;

10/ Establish regulatory laboratory as necessary;

11/ Design and implement a systematic procedure for the implementation of the regulatory activities with regard to the mass media and other concerned bodies with respect to the technologies to be controlled;

12/ Cooperate with national and international organizations having similar objectives in the implementation of the international conventions ratified by Ethiopia;

13/ Receives and regulates actions taken by another country regulatory body based on bilateral and multilateral agreement and cooperation;

14/ Own property, enter into contracts, sue and be sued in its own name.

15/ Carryout other activities as necessary for attaining its objective;

6. Organization of the Authority

The Authority shall have:

1/ Director General

2/ Deputy Director Generals as required and

3/ The necessary staff.

7. Power and Duties of the Director General

The   Director   General   shall have  the following power and duties:

1/  Shall be the chief executive officer of  the Authority, and shall direct and manage the activities of the Authority;

2/ Without limiting the generality of Sub- Article (1) of this Article, the Director General shall:

  1. Exercise the powers and duties of the Authority specified under Article 5;
    1. Employee, administer the employees of the Authority in accordance with the laws of the Federal Civil Service;

3/ Prepares and submits reports of the activities of the Authority to the Ministry;

3/ The Director General may delegate  part of his power and duties to the officials and employees of the Authority to the extent necessary for the effective performance of the activities of the Authority.

8.  Power and Duties of Deputy Director General

The Deputy Director General shall have the following powers and duties:

1/ Plans, directs and coordinates the activities of the sub-sector it leads;

2/ In the absence of the Director General and upon delegation shall act in place of the Director General; failing such delegation a Deputy Director General with the longest tenure shall be designated;

3/ Perform any other duties  assigned  by  the Director General.

8.    Budget

The budget of the Authority shall be allocated by the Government.

10. Books of Accounts

1/ The Authority shall keep complete and accurate books of accounts.

2/ The books of accounts and financial documents of the Authority shall be audited annually by Auditor General or by Auditor designated by him.

11. Effective Date

This Regulation shall enter into force upon the date of publication in the Federal Negarit Gazette.
