Proclamation No……../2018
A PROCLAMATION TO PROVIDE FOR FOOD and MEDICINE ADMINISTRATION

WHEREAS, it is necessary to prevent and control the public’s health from health hazards caused by unsafe food;
WHEREAS, it is necessary to prevent and control the public’s health from unsafe, inefficacious and poor quality medicines, and unsafe and ineffective medical devices;
WHEREAS, it is necessary to prevent and control the illegal distribution and use of narcotic drugs, psychotropic substances, and precursor chemicals;
WHEREAS, it is necessary to install a regulatory scheme compatible with the country’s expanding industry and manufacturing sector;
WHEREAS, it is necessary to prevent and control the public’s health from the devastating health, social, and economic consequences of tobacco products;
WHEREAS, it is necessary to adopt a national legal framework that enables to establish a coordinated food, medicine, medical device, cosmetics, and tobacco products regulatory system; and
NOW, THEREFORE, in accordance with Article 55(1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follow:

PART ONE
GENERAL

1. Short title

This proclamation may be cited as the “Food and Medicine Administration Proclamation No……/2018”

2. Definitions

In this Proclamation, unless the context otherwise requires:
1) “food” means any substance, whether processed or semi-processed, which is intended for human consumption, and includes plants, and plant and animal products placed on the market or offered for use by the public; salt, water, alcohol, and other drink, and any substance which has been used in the manufacture or treatment of food but does not include medicine, cosmetics, and tobacco products;
2) “food safety” means the conditions and practices that preserve food is fit for human consumption during manufacturing, handling, storage, or transport;
3) “irradiation” means a deliberate exposure of food to ionizing radiation;
4) “medicine” means any substance or mixture of substance:
a) used in the diagnosis, treatment, mitigation or prevention of human disease, disorder, abnormal physical or mental state, or the symptoms thereof;
b) used in restoring, correcting or beneficial modification of organic or mental functions in human; or
c) articles other than food, intended to affect the structure or any function of the body of human;
and it includes articles intended for use as a component of any articles specified in clause (a), (b) or (c).

5) “pharmacy professional” means a pharmacist, druggist, or pharmacy technician licensed by the appropriate health professional regulatory organ;
6) “narcotic drugs” means a medicine subject to control in accordance with the Convention issued by United Nations and ratified by Ethiopia and include a drug that is categorized as narcotic drug by the executive organ;
7) “psychotropic substances” means any substance subject to control in accordance with the Convention issued by United Nations and ratified by Ethiopia and include a drug that is categorized as psychotropic substance by the executive organ;
8) “precursor chemical” means any substance or mixture of substances subject to control in accordance with the Convention issued by the United Nations and ratified by Ethiopia and include a substance that is categorized as precursor chemical by the executive organ;
9) “prescription” means a paper or electronic order for medicine that meets requirements set by the executive organ, and written and signed by a duly licensed medical professional;
10) “raw material” means the basic material from which a regulated product is made;
11) “counterfeiting” means a deliberate or fraudulent mislabeling of a product in respect of its identity and/or source including the packing material, identification or trademark, trade name, any special mark thereon of an authentic product and presenting such falsely labeled product as if it is manufactured by the genuine manufacturer;
12) “adulteration” means adding any foreign substance or ingredient or substituting the content of the product in whole or in part by such other substance so as to increase its bulk or weight, or reduce its quality or strength, or make it appear better or of greater value than it is;
13) “pharmacopeia” means a document accepted by the appropriate organ containing the particulars of medicine preparation, physical aspects of medicine and non-medicinal substances, preoperational aspect, content, intensity and standards and criteria’s to be fulfilled related to such particulars;
14) “medical device” means any instrument, apparatus, implement, machine, appliance, implant, reagent for in vitro use, software, material or other similar or related articles and their accessories, intended by the manufacturer to be used, alone or in combination, for human beings, for one or more of the specific medical purpose(s) of:
a) diagnosis, prevention, monitoring, treatment or alleviation of disease or injury,
b) investigation, replacement, modification, or support of the anatomy or of a physiological process,
c) supporting or sustaining life,
d) control of conception,
e) disinfection of medical devices,
f) providing information by means of invitro examination of specimens derived from the human body;
and does not achieve its primary intended action by pharmacological, immunological or metabolic means, in or on the human body, but which may be assisted in its intended function by such means.
15) “clinical trial” means any systematic study on medicine or medical devices in volunteer human subjects in order to discover or verify the effects of, and/or identify any adverse reaction to the products, and or to study its absorption, distribution, metabolism, and excretion with the object of ascertaining their efficacy and safety;
16) “bioequivalence center” means the center in which two types of medicine productions are ascertained by research as to their similarity of efficacy and safety;
17) “public health pesticide” means any substance or mixture of substances used to prevent, control or destroy pests to protect human health and includes pesticide-treated mosquito net;
18) “cosmetic” means any article intended to be used by means of rubbing, pouring, steaming, sprinkling, spraying on or otherwise applied to the human body or any part thereof for cleansing, beautifying, promoting attractiveness or altering the appearance and, any article intended for use as component of a cosmetic but such articles excludes laundry soaps, articles intended for the diagnosis, treatment, mitigation or prevention of human disease, and products intended to affect the anatomy or of a physiologi¬cal process of a human;
19) “tobacco product” means a product entirely or partly made of the leaf tobacco as raw material which are manufactured to be used for smoking, sucking, chewing, or snuffing;
20) “tobacco product special regulatory license” means a permit granted by the executive organ for the purpose of tobacco manufacturing, import, wholesale, or sell but this does not include a trade license;
21) “barcode” means a machine-readable code in the form of numbers and a pattern of parallel lines printed on and identifying a product for the purpose of monitoring by the manufacturer or executive organ;
22) “means of advertisement dissemination” includes the mass media, outdoor advertisement, telecom, postal, internet website and fax services, cinema, film, video and any other related means of advertisement dissemination;
23) “regulated product” means any product administered in accordance with this proclamation and includes food, medicine, medical device, cosmetic, and tobacco products;
24) “medical professional” means a physician or other health professional who is authorized by the appropriate organ to examine and diagnose human diseases and treat them by drug, surgical operations or other related medical means;
25) “packing” means any article that may be used for filling, inserting or wrapping or packing regulated products and includes the immediate container and other wrapping materials;
26) “label “means all labels and other written, printed, or graphic material that is affixed to a regulated product or any of its container or wrapper and includes insert;
27) “repacking” means packing of any processed or semi-processed regulated products by a different manufacturer in any other way;
28) “ inspector ” means any professional authorized by the executive organ or regional health regulator to perform inspection activities pursuant to this Proclamation;
29) “institution registration” means a recognition granted to regulated institution in accordance with set requirements;
30) “product registration” means a recognition granted to regulated product in accordance with set requirements;
31) “quality control system” means a procedure intended to ensure that a regulated product meets quality and safety requirements;
32) “institution” means any establishment involved in the manufacture, export, import, wholesale, retail, or repacking of regulated products;
33) “manufacture” means all operations involved in transforming raw materials into regulated products under this proclamation including in the preparation, processing, compounding, formulating, filling, packing, packaging, and repackaging;
34) “certificate of competence” means a permit issued for a person to carry out the manufacture, import, distribute, wholesale, sale, or retail trade of regulated products under this proclamation; quality control provider, bioequivalence center, or other purposes regulated under this proclamation; however, it does not imply a trade license;
35) “executive organ” means a body which is empowered to administer this proclamation and other laws issued to implement this proclamation at the federal government level;
36) “region” means any state referred to under Article 47 of the Constitution of the Federal Democratic Republic of Ethiopia and includes the Addis Ababa and Dire Dawa City Administrations;
37) “regional health regulator” means a regional government body which is empowered to administer this proclamation and other laws issued to implement this proclamation at regional government level;
38) “appropriate body” means, as applicable, other organs that have a legitimate interest in the course of implementation of powers granted under this proclamation;
39) “person” means a natural and juridical person; and
40) any expression in the masculine gender includes the feminine.

A PROCLAMATION TO AMENED THE ESTABLISHMENT OF ETHIOPIAN INSTITUTION OF THE OMBUDSMAN

WHEREAS, it is provided in the Constitution of the Federal Democratic Republic of Ethiopia the conduct of affairs of the government shall be transparent and that any public official shall be accountable for failure in official duties,

WHEREAS, the interlinkage of the activities, and of decision-making powers of executive organs of government with the daily lives and the rights of citizens is an ever-increasing and widening circumstance and it is necessary to make sure that Executive organs act within constitutional parameters,

Aware that a free and independent institution of Ombudsman with high institutional and functional autonomy plays an indispensable role in the national endeavor building order of good governance in Ethiopia and

Cognizant of the necessity of preserving and consolidating past achievements and positive practices pertaining to awareness creation, supervision and investigation while removing legal impediments that hinder executing remedies provided by the Ethiopian Institution of Ombudsman,

NOW, THEREFORE, in accordance with sub-Articles (1) and (15) of Article 55 of the Constitution of the Federal Democratic Republic of Ethiopia; it is hereby proclaimed as follows:

PART ONE

GENERAL

  1. Short Title

This Proclamation may be cited as the “The Ethiopian Institution of the Ombudsman Establishment(Amendment) Proclamation No………/………˝

  1. 2. Definitions

Unless the context requires otherwise, in this Proclamation:

1/ “House” means the House of Peoples’ Representatives of the Federal Democratic Republic of Ethiopia;

2.“Appointee” means the Chief Ombudsman or the Deputy Chief Ombudsman or Women, Children, and Persons with Disability Ombudsman and the branch Ombudsman, appointed by the House, in accordance with this Proclamation;

3/˝ Institution” means the Ethiopian Institution of the Ombudsman;

4/ “Maladministration” includes acts committed , decisions given or failure to givedecision, omission by executive organs or Public Development Enterprise,in contravening applicable laws related to administration;

5/ “Law” includes the Constitution of the Federal Democratic Republic of Ethiopia, the Constitution of a Region as well as federal or regional laws and regulations;

6/ “Government” means the Federal or Regional Government;

7/ “Region” means any of those specified under Article 47 (1) of the Constitution of the Federal Democratic Republic of Ethiopia and, for the purpose of this Proclamation, includes the Addis Ababa  and Dire Dawa City Administration;

8/“Government Office” means Ministry, Commission, Authority, Agency, Institute or any public enterprise;

9/ “Public Enterprise” means a production, distribution, service-rendering or other enterprise, under the ownership of the Government;

10/ “Executive Organ” includes government office or public enterprise as well as organs rendering administrative or related services within the judiciary or the legislature;

11/“Official” means an elected representative or an appointee or official of an executive government organ;

12/ “Staff˝means employees of the institution, which includes directors,head of chief ombudsman office, team leaders,professionals and support staff of the Institution;

13/ “Investigator” means a staff assigned, by Chief Ombudsman or at the branch level by branch office ombudsman,to conduct an investigation on maladministration;

14/Systemic Investigation is the process of examining a maladministration concerning structure of executive organ, or a maladministration, which will affect a group of people.

15/“Family Member” means a person related to each other by consanguinity or affinity, in accordance with the Federal and Regional Family laws;

16/˝Third party” means a person who is elected represent a group or association or recognized civic society (anon-governmental organization representing an individual or a group);

17/“Person” means any natural or juridical person;

  1. Gender Expression

Provisions of this Proclamation set out in the masculine gender shall also apply to the feminine gender.

  1. Scope of Application

This Proclamation shall apply to maladministration committed by the executive organs, and officials thereof, of a Government.

PART TWO

THE ETHIOPIAN INSTITUTION OF OMBUDSMAN

  1. Re-establishment

1/The Ethiopian Institution of the Ombudsman (hereinafter referred to as “the Institution”) is hereby re-established in accordance with the Federal Democratic Republic of Ethiopia Constitution Article 55 (1) and (15)as an autonomous organ having its own juridical personality.

2/ The Institution shall have its Head Office in Addis Ababa, and it may have branch offices in other places to be determined by the council.

  1. Objective of the Institution

The objective of the Institution shall be bringing about good governance that is of high quality, efficient and transparent based on the rule of law, by way of ensuring that people’s rights and benefits, provided for by a law are respected by organs of the executive.

  1. Powers and Duties of the Institution

The Institution shall be accountable to the house, and it have the following powers and duties:

1/ to supervise regulations or administrative directives that issued by executive organs or decisions given by executive organs and the practices thereof do not contravene the constitutional rights of citizens and a law as well;

2/ to conduct investigation on the basis of complaints submitted or on its own initiation on maladministration or conduct systemic investigation on important issues,

3/ to recommend appropriate remedies where it believes that maladministration has occurred;

4/ conduct supervision, with a view to ensuring that the executive carries out its functions in accordance with the law and to prevent maladministration;

5/ undertake studies and finding solutions to take actions on maladministration and give recommendation;

6/ make recommendations for the revision of existing laws, practices or directives and for the enactment of new laws and formulation of policies, with a view to bringing about good governance;

7/ provide advice to the government on the issue of good governance;

8/ create awareness of good governance and on matters related to administrative justice;

9/ participate in international Good-governance related meetings or conferences or symposia,

10/ perform such other related activities as required for the attainment of its objectives;

  1. Limitation of Power

The Institution shall have no power to investigate:

1/ decision given by councils, established by election, in their legislative capacity;

2/decision given or cases pending in courts of law or quasi- judicial organs;

3/ decision given or cases pending on matters under investigation by the Federal or Regional Office of the Auditor-General; or

4/ decision given by police Forces or Defense Forces, in respect of matters of national security or defense.

PART THREE

ORGANIZATION OF THE INSTITUTION AND RESPONSIBILITIE

  1. Organization of the Institution

The Institution shall have:

  1. A council of the Ombudsman;
  2. A Chief Ombudsman;
  3. A Deputy Chief Ombudsman;
  4. An ombudsman heading the women, children and persons with disability;
  5. Branch office ombudsman; and
  6. The necessary staff.
  7. Council of the Institution

1/ Council of Ombudsmen (hereinafter referred to as “the Council”) is hereby re-established.

2/ The Council shall have the following members:

  1. a) Chief Ombudsman —————             Chairperson
  2. b) Deputy Chief Ombudsman ———Deputy Chairperson
  3. c) Women, children and persons with disabilities Ombudsman…………member
  4. d) Branch office Ombudsman ——————- Member

3/ The Council may elect its secretary from members of the council.

4/ The Council may draw-up its own rules of procedure.

  1. Powers and Duties of the Council

The Council shall have the following powers and duties:

1/ adopt directives and by-laws necessary for the implementation of this Proclamation;

2/ discuss on draft budget of the Institution;

3/ notwithstanding the Federal Civil Servants Proclamation, the council

  1. may undertake and implement organizational structure study as may be appropriate for its functions;
  2. shall study a special salary scale of the employees and submit the study to the House and implement the same up on approval
  3. administration of the employees of the institution shall be governed by directives to be issued by the council
  4. undertake and implement employment benefits scheme for its employees

4/ appoint directors;

5/ hear disciplinary cases relating to directors;

6/ examine and render a final decision on cases, petitions or complaints submitted to it in relation to staff administration;

  1. Powers and Duties of Chief Ombudsman

1/ The Chief Ombudsman shall be accountable to the house and the superior head of the Institution and, as such, shall exercise the powers and duties of the Institution provided for under this Proclamation.

2/ without prejudice to the generality stated under sub-Article (1) of this Article, the Chief Ombudsman shall:

  1. a) Employ and administer the staff, in accordance with the directive to be adopted by the Council.
  2. b) Preparedraft budget which is consulted by the council, directly submit to the Houseand implement same upon approval;
  3. c) transfer a case, where he has sufficient grounds, from one investigation section or investigator to another or, himself, investigate a case of maladministration occurring anywhere;
  4. d) Undertake study of recurrent cases of maladministration and forward together with remedial proposals to the House;
  5. e) Prepare and submit draft administrative legislations, give his opinion on those prepared otherwise;
  6. f) Submit a report to the House on matters of maladministration and on the activities of the Institution;
  7. g) Take part in meetings by way of representing the Institution, establish working relations with Federal and Regional government organs as well as with non-governmental organizations;
  8. h) Organize,coordinate, follow up and monitor the activities of branch offices;
  9. i) Undertake such other activities as are assigned to him by the House.

3/ If it is believed that the complaintwill bring unreplaceable damage on the compliant, the Chief Ombudsman shall give order to injunction.

4/The chief ombudsman may, to the extent necessary for the efficient performance of the Institution, delegate part of his powers and duties, other than those specified under sub-Article (2) (b), (e) and (f) of this Article and under Article 42, to Ombudsmen or to other staff members of the Institution.

  1. 13. Powers and Duties of the Deputy Chief Ombudsman

The Deputy Chief Ombudsman shall be accountable to the chief Ombudsman and have the following powers and outies,

1/ Assist the Chief Ombudsman in planning, organizing, directing and coordinating the activities of the Institution;

2/ Undertake the activities of the Chief Ombudsman, in the absence of the latter;

3/ Carry out such other activities as may be assigned to him by the Chief Ombudsman.

  1. Powers and Duties of Women, Children and Persons with Disabilities Ombudsman

The women,children and persons with disabilities Ombudsman shall be accountable to the chief Ombudsman and have the duties,

1/Assist the chief ombudsman in planning, organizing, directing and coordinating the activities of Women, Children and persons with disabilities.

2/Carry out such other activities as may be assigned by the chief ombudsman.

  1. Powers and Duties of branch office Ombudsman

The Branch ombudsman shall be accountable to the chief ombudsman and have the following powers and duties in addition to exercising, within the local jurisdiction of a branch office, the powers and duties of the Institution specified under Article 5(2) of this Proclamation; an Ombudsman shall, as the superior head of a branch office, have the following powers and duties:

1/ to ensure that administrative and other laws, regulations and directives are observed;

2/ to transfer an administrative case from one investigation section or investigator to another or to conduct investigation himself, where necessary;

3/ to submit detail report on matters of maladministration to the Chief Ombudsman, andnotify to the Council of the Region in written form;

4/ to forward proposals for the revision of laws and practices inconsistent with principles of good governance;

5/ to direct the branch office, in accordance with directives issued from theCouncil of the Institution;

6/ to effect payments in accordance with the budget allocated to the branch office;

7/ to establish working relations, as a representative of the branch office, with Regional government organs and non-governmental organizations operating within its local jurisdiction;

8/ to perform such other functions as are assigned to him by the Chief Ombudsman.

PART FOUR

ETHIOPIAN INSTITUTION OF THE OMBUDSMAN APPOINTEES, APPOINTMENT

  1. Appointment

1/ The Appointees of the Institution shall be appointed by the House.

2/ the appointment of the Appointees shall be made as under the following procedure:

  1. a) The appointees shall be recruited by a Nomination Committee to be formed pursuant to Article 17 hereunder;
  2. b) The nominees shall have to receive the support of a two-thirds vote of the members of the Committee;
  3. c) The list of nominees shall be presented to the House, by the Speaker, for it to vote upon;
  4. d) The nominees shall be appointed upon receipt of a two-thirds vote of the House.
  5. Composition of the Nomination Committee

The Nomination Committee shall have the following members:

1/              the Speaker of the House ………………………………………………………     Chairperson

2/ the Speaker of the House of Federation …………………………………                   Member

3/ five members to be elected from among members, by the House

4/ two members of the House to be elected by joint agreement of competent political parties having seats in the House ……………………                                                                     “

  1. Criteria for Appointment

Any person who may be appointed as an Ombudsman:

1/ is an Ethiopian national;

2/is loyal to the Constitution of the Federal Democratic Republic of Ethiopia;

3/ holds degree in law, public administration or other relevant discipline from recognized university with extensive work experience;

4/ be neutral from any political party;

5/ is reputed for his diligence, honesty and good conduct;

6/ has not been convicted for a criminal offence other than petty offence;

7/be in a good health condition to carry out his duties; and

8/ is above thirty-five years of age.

  1. Term of the Office

1/The term of office of appointees shall be six years.

2/uponexpiry of the term of the office specified under sub-Article (1) of this Article, the appointees may be re-appointedonly forone additional term.

  1. Salary and their Benefits

1/the salary and other benefits of the appointees shall be determined in accordance with the law issued to provide for the benefits of government Appointees.

2/ An appointee discharged from responsibility or removed from office, as under Article 21 (1) hereunder, shall not unless re-appointed, assume a post in legislative, executive and judicial organs for about six months thereafter.However, the appointee will get the previous salary and benefits for six months.

  1. Grounds for Removal of an Appointee

1/ An appointee may be removed from office or discharged from responsibility upon the following circumstances:

  1. a) upon resignation, subject to a three-month prior written notice; or
  2. b) where it is ascertained that he is incapable of properly discharging his duties, due to illness; or
  3. c) where he is found to be corrupted or to have committed other unlawful act; or
  4. d) where it is ascertained that he is of manifest incompetence; or
  5. e) upon termination of his term of office.

2/ Within three months of the removal or discharge of an appointee, as under sub-Article (1) of this Article, there shall be replaced another appointee shall be made to replace him.

  1. Procedure for Removal of an Appointee

1/ An Appointee shall be removed from appointment, upon the grounds specified under Article 21 (1) (b – d) herein, subsequent to investigation of the matter by a Special Inquiry Tribunal to be formed under Article 23 hereof.

2/ An Appointee shall be removed from appointment, where the House finds that the recommendation submitted to it, as supported by the majority vote of the Special Inquiry Tribunal, is correct and where it upholds same by a two-thirds majority vote.

23 .Composition of the Special Inquiry Tribunal

The Special Inquiry Tribunal shall have the following members:

1/ the Deputy Speaker of the House ……………….                            Chairperson

4/ a member of the House to be elected by joint agreement of competent parties having seats in the House ……..       “

  1. Prohibition to Engage in Other Employment

1/ An appointee shall not be allowed to engage in other gainful, public or private employment during his term of office.

2/ Notwithstanding the provisions of sub-Article (1) of this Article, the House may allow otherwise in consideration of the particular profession in which the appointee is required to make contribution.

PART FIVE

LODGING COMPLIANTS AND INVESTIGATION PROCEDURES

  1. The Right to Lodge Complaints:

1/ A complaint may be lodged by a person, claiming to have suffered from maladministration or by a third party.

2/ The Institution may, in consideration of the gravity of the maladministration committed, receive anonymous complaints.

3/ Prior to lodging a complaint to the Institution, in respect of an act of maladministration from which he suffered, any person shall bring the complaint before the relevant organs.

4/without prejudice to the provisions of Article 8 hereof, the right to lodge complaints, as under this Proclamation, shall be no bar to the institution of criminal or civil proceedings over the same case.

5/ The Institution shall receive and investigate complaints, free of any charge.

  1. Lodging Complaints

1/ A Complaint may be lodged with the Institution orally, in writing or in any other manner.

2/ Complaint shall, to the extent possible, be submitted together with supporting evidence.

3/ Complaint may be made in Federal or Regional working language.

  1. Ordering the Production of Evidence

In order to undertake necessary examination, within a reasonable time, the Institution may order that:

1/ those complained against appear, at a specific time and place, for questioning or that they submit their defense;

2/ witnesses appear, at a specific time and place, and give their testimony;

3/ any person in possession of evidence, relevant to the case, produce same, at a specific time and place.

  1. Remedies

1/ The Institution shall make all the effort it can summon to settle, amicably, a complaint brought before it.

2/ It shall notify, in writing, the findings of its investigation, and its remedies thereon, to the superior head of the concerned organ.

3/ The remedy proposed by the Institution, pursuant to sub-Article (2) of this Article, shall expressly state that the act or practice having caused the maladministration be discontinued or that the directive having caused same be rendered inapplicable and that the maladministration committed be rectified or that any other appropriate measure be taken.

4/ the institutions shall inform complainant on the results of the investigation in writing.

5/ Complaints submitted to the Institution shall be accorded due response, within a short period of time.

  1. Duty of Executive Organs

1/Any individual, employees or officials up on request by investigator or appointee or any official of the Institution shall, forth with make relevant and necessary documents or response which the investigator,appointee or any official of Institution deemed it useful and necessary for investigation.

2/ The respondent are obliged to take corrective measures, within 30 days from the date of delivery, on findings and remedies sent to them by the Institution; if they are unable to take such measures, shall inform the same and the good reasons thereof to the Institution with in the period specified herein.

  1. The Right to appeal

1/ Any complainant or executive organ shall have the right to object to the appointee or director or investigator, next in hierarchy, where he is aggrieved by finding of investigation and remedy proposed by a subordinate appointee or director of the Institution, within 30 days from the time he is notified, in writing, of such proposed remedy.

2/ A director or an appointee who receives an objection, pursuant to sub-Article (1) of this Article, may modify, stay the execution of, reverse or confirm thefinding of investigation and remedy or decision having been proposed.

3/ The chief ombudsman shall give decision within 30 days and be final.

  1. Penalty

1/Any person who;

a/has received summons from the Institution, or been called upon by it otherwise, does not appear; or

b/does not appear or respond to bring documents of investigation or supervision  upon the request of the Institution ;or

c/ obstructs the proper carrying out of the investigation or supervision of Institution; or

d/causes harm to witnesses,  complainants or any person  that cooperates by any means with the institution; or

e/fails to take measures, on the findings of investigation or supervision of recommendationswithout good reasons , within 30 days from received findings of investigation or supervision and recommendations of the institution, shall be punishable with imprisonment from five to seven years or with a fine birr 10,000 ( ten thousand birr) or with both.

2/ any person who has committed the offences mentioned pursuant to this Article sub-Article 1 (a) to (e), shall be made accountable by law, the institution shall report the case with supportive evidences to the concerned attorney office. The attorney office, upon, receiving order from the institution, shall open criminal suite relying on legal procedures.

  1. Duty to Notify

Where the Institution, in the process of conducting investigations, believes that a crime or an administrative fault is committed, it shall have the duty to, forthwith, notify same to the concerned organ or official.

  1. Overlap of Jurisdiction

1/ Where cases falling both under the jurisdiction of the Institution and of the Ethiopian Human Right Commission materialize, the question of which of them would investigate same shall be determined upon their mutual consultation.

2/ Failing determination of the matter, as under sub-Article (1) of this Article, the organ having pendency shall undertake the investigation.

  1. Duty to Cooperate

Any person shall provide the necessary assistance and duty to cooperate with a view to helping the Institution exercise its powers and duties.

  1. Reporting

1/ The Institution shall issue an official report on investigation, supervision and research findings through mass media as may be necessary.

2/ The Institution shall exercise transparency in respect of its mode of operation, including issuance of regular reports.

3/ If the executive organ fails or refuses to implement the findings of investigation and recommendation of the institution with in the specified time, the institution may prepare and submit to the House a special report detailing the failure or refusal to implement its recommendations and the House shall take appropriate action.

4/Notwithstanding the provisions of sub-Article  (1) ,(2) and (3) of this Article, the Institution shall have the duty to exercise caution in respect of matters to be kept secret, with a view to not endangering national security and well-being or to protecting individual lives.

  1. Non-Answerability for Defamation

1/ No complaint lodged pursuant to this Proclamation shall entail liability for defamation.

2/ No report of the Institution submitted to the House, on the findings of an investigation undertaken, nor any other correspondence of the Institution, relating to its activities, shall entail liability for defamation.

  1. Immunity

No:

1/ appointee, or

2/ investigator , any expertise of the institution appointed to examine maladministration investigation or  director of investigation office of the Institution may not be arrested , accused or  detained without the permission of the House or the Chief Ombudsman, respectively, except when caught in flagrante delicto, for a serious offence.

PART SIX

MISCELLANEOUS

  1. Budget

1/ The budget of the Institution shall be drawn from the following sources:

  1. a) Budgetary subsidy to be allocated by the government;
  2. b) Assistance, grant and any other source.

2/  A proportionate quarterly appropriations of the operational budget of approved budget of the Institution shall be deposited in advance in the bank account opened in the name of the Institution.

  1. Books of Accounts

1/ The Institution shall keep complete and accurate books of accounts.

2/ The accounts of the Institution shall be audited, annually, by an organ to be designated by the House.

  1. Appeal

1/ Any director of the Institution aggrieved by administrative decisions rendered by the Council as per Article 11 (5) may appeal to the Speaker of the House within 30 days from the date such decision has been made.

2/ Decisions rendered by the Speaker of the House pursuant sub-Article (1) of this Article shall be final.

  1. Utilization of Outside Professionals

The Institution may utilize, for a specific task and for a definite duration, outside professionals necessary for its functions, subject to making appropriate remunerations.

  1. Observance of Secrecy

Unless ordered by a court or otherwise permitted by the Chief Ombudsman, any appointee or Professional employed pursuant to Article 41 of this Proclamation or staff or any other person shall have the obligation not to disclose, at all times, any secret known to him in connection with his duty.

43.The power to issue Regulations and Directives

1/ The House may issue necessary Regulations for the implementation of this proclamation.

2/ The council may issue Directives for the implementation of this proclamation and regulation.

  1. Transitory Provision

Complaints on maladministration that are under investigation by the Institution, prior to the enactment of this Proclamation, shall be investigated by the previous law of the Institution.

  1. Inapplicable Laws

1/ The proclamation to established Ethiopian Institution of the Ombudsman proclamation No, 211/2000 is here by repealed.

2/No law or practice, inconsistent with this Proclamation, shall be applicable in respect of matters provided for in this Proclamation.

  1. Effective Date

This Proclamation shall enter into force up on the date of publication in the Federal Negarit Gazeta

የኢትዮጵያ ሕዝብ ዕንባ ጠባቂ ተቋም ማቋቋሚያ አዋጅን ለማሻሻል የወጣ አዋጅ

የኢትዮጵያ ፌዴራላዊ ዲሞክራሲያዊ ሪፐቭሊክ ህገ መንግስት የመንግስት አሰራር ለህዝብ ግልጽ በሆነ መንገድ መከናወን እንዳለበትና የመንግስት ባለስልጣን ኃላፊነቱን ሲያጓድል ተጠያቂ እንደሚሆን በመመልከቱ፣

የመንግስት አስፈጻሚ አካላት የሚያከናውኗቸው ተግባራት ከዜጎች የዕለት ተዕለት ሕይወት ጋር ያላቸው ቁርኝት ከመብታቸው ጋር በተሳሰረ ሁኔታ የሚኖራቸው የወሳኝነት ሥልጣን ከጊዜ ወደ ጊዜ እየሰፋ በመምጣቱና አስፈጻሚ አካላት ተግባራቸዉን ተፈጻሚ ህገ-መንግስታዊ ወሰንን ያላለፈ መሆኑን ማረጋገጥ በማስፈለጉ፣

የአስተዳደር በደል እንዳይፈጸም አስቀድሞ በመከላከል ወይም ተፈጽሞ ሲገኝ በአፋጣኝ እንዲታረም በማድረግ በሀገራችን የመልካም የአስተዳደር ሥርዓትን ለመገንባት የሚደረገው ጥረት ስኬታማ የሚሆነው ተቋማዊ  የአሠራር ነጻነቱ የተረጋገጠ የሕዝብ ዕንባ ጠባቂ ተቋም ሲኖር መሆኑን በመረዳት፣

በአስፈጻሚ አካላት የሚፈጸሙ የአስተዳደር በደሎች ወይም የሕግ ጥሰቶች እንዲታረሙ በተቋሙ የሚሰጥ የመፍትሔ ሐሳብ ለማስፈጸም መሰናክል የነበረን ክፍተት በማስወገድ በምርመራ እና ቁጥጥር ሥራዎቻችን ያዳበርናቸውን አዎንታዊና ገንቢ ልምዶች የመጠበቅንና ይበልጥ የማጠናከርን አስፈላጊነት በማመን፣

በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ-መንገስት አንቀጽ ፶፭(፩) እና (፲፭) መሰረት የሚከተለው ታውጇል፡፡

ክፍል አንድ፤ ጠቅላላ

፩. አጭር ርዕስ

ይህ አዋጅ “የኢትዮጵያ ሕዝብ ዕንባ ጠባቂ ተቋም ማቋቋሚያ  አዋጅን ለማሻሻል የወጣ አዋጅቁጥር —/—”  ተብሎ ሊጠቀስ ይችላል፡፡

፪. ትርጓሜ

የቃሉ አገባብ ሌላ ትርጉም የሚሰጠው ካልሆነ በስተቀር በዚህ አዋጅ ውስጥ

፩. “ምክር ቤት” ማለት የኢትዮጵያ ፌደራላዊ ዲሚክራሲያዊ ሪፐብሊክ የሕዝብ ተወካዮች ምክር ቤት ማለት ነው፡፡

፪. “ተሿሚ” ማለትበምክር ቤት የሚሾም ዋና ዕንባ ጠባቂን፣ ምክትል ዋና ዕንባ ጠባቂ፣የሴቶች፣የህፃናትና የአካል ጉዳተኞች ዕንባ ጠባቂ እና የቅርንጫፍ ዕንባ ጠባቂ ነው፡፡

፫.  “ተቋም” ማለት የኢትዮጵያ ህዝብ ዕንባ ጠባቂ ተቋም ማለት ነው፡፡

፬.  “የአስተዳደር በደል” ማለት ስልጣን ባለዉ አካል የወጣ እና በስራ ላይ ያለን ሕግን  በመፃረር በመንግስት አስፈፃሚ አካላት ወይም በመንግስት የልማት ድርጅቶች  የሚፈፀሙ ድርጊት ወይም የሚሰጥ ውሳኔ ወይም ትዕዛዝ ማለት ሲሆን የተሰጠን ውሳኔ ወይም ትዕዛዝ አለመመፈጸምንይጨምራል፡፡

፭.  “ሕግ” ማለት የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ህገ መንግስት፣የክልል መንግስታት ህገ መንግስት እና በፌደራል ወይም በክልል መንግስታት የሚወጡ ህጎች ማለት ነው፡፡

፮.  “መንግስት” ማለት የፌደራል ወይም የክልል መንግስት ነው፡፡

፯. “ክልል” ማለት በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ-መንግስት አንቀጽ ፵፯(፩) ላይ የተመለከቱት ማለት ሲሆን ለዚህ አዋጅ አፈፃፀም ሲባል የአዲስ አበባ ከተማ አስተዳደር እና የድሬደዋ አስተዳደርን ይጨምራል፤

፰. “የመንግስት መስሪያ ቤት” ማለት ሚኒስቴር፣ኮሚሽን፣ባለስልጣን፣ኤጀንሲ፣ኢንስቲቱት ወይም ማናቸውም ሌላ የመንግስት መስሪያ ቤት ነው፤

፱. “የመንግስት የልማት ድርጅት” ማለት በመንግስት ባለቤትነት ስር የሚገኝ የማምረቻ፣የማከፋፈያ፣አገልግሎት ሰጭ ወይም ሌላ አይነት ድርጅት ነው፤

፲. “አስፈፃሚ አካል” ማለት የመንግስት መስሪያ ቤትን  ወይም የመንግስት የልማት ድርጅትን እንዲሁም በዳኝነት ሰጭ ወይም በህግ አውጪው አካል ውስጥ የአስተዳደር ወይም የአስተዳደር ነክ አገልግሎት የሚሰጥ አካልን ይጨምራል፤

፲፩. “ባለስልጣን” ማለት የሕዝብ ተመራጭ ወይም የመንግስት አስፈጻሚ አካል ተሿሚ ወይም ኃላፊ ነው፤

፲፪. “ሠራተኛ” ማለት የተቋሙዳይሬክተሮችን፣የዋና ዕንባ ጠባቂ ጽ/ቤት ኃላፊን፣ ቡድን መሪዎች፣ ባለሙያዎችንና ድጋፍ ሰጪ ሰራተኞች ይጨምራል ፤

፲፫. “መርማሪ” ማለት የምርመራ ስራ እንዲያካሂድ በዋና ዕንባ ጠባቂው ወይም በቅርንጫፍ ፅህፈት ቤት ደረጃ ደግሞ በቅርንጫፍ ዕንባ ጠባቂው የተመደበ ሰራተኛ ነው፤

፲፬. “ስልታዊ ምርመራ” ማለት በመንግስት የአስተዳደር መዋቅር ላይ የተከሰቱ የአስተዳደር ችግሮችን የሚመለከቱ ሲሆን በባህሪያቸዉ በበርካታ የህብረተሰብ ክፍል ላይ ጉዳት ሊያከትል በሚችል ጉዳዮች ላይ የሚካሄድ ምርመራ ማለት ነዉ፡፡

፲፭. “ቤተ ዘመድ” ማለት በክልል የቤተሰብ ህግ ወይም በተሻሻለው የፌደራል የቤተሰብ ህግ መሰረት የስጋ ወይም የጋብቻ ዝምድና ያለው ሰው ነው፣

፲፮. “ሶስተኛ ወገን” ማለት አንድን ግለሰብ ወይም ቡድን የሚወክል የሕዝብ ተመራጭ ወይም ማህበር ወይም “የመብት ተሟጋች” ድርጅት ማለት ነዉ፡፡

፲፯ “ሰው” ማለት ማንኛውም የተፈጥሮ ሰው ወይም በሕግ የሰውነት መብት የተሰጠው አካል ነው፤

፫.ስለ ፆታ አገላለፅ

በዚህ አዋጅ በወንድ ፆታ የተደነገገው ለሴት ፆታም ያገለግላል፡፡

.የተፈፃሚነት ወሰን

ይህ አዋጅ በየደረጃው በሚገኙ የመንግስት አስፈፃሚ አካላት በሚፈፀሙ የአስተዳደር በደሎችና ባለስልጣኖች ላይ ተፈፃሚነት ይኖረዋል፡፡

ክፍል ሁለት

ስለኢትዮጵያ የህዝብ ዕንባ ጠባቂ ተቋም

፭. እንደገና መቋቋም

፩.  የኢትዮጵያ ሕዝብ ዕንባ ጠባቂ ተቋም (ከዚህ በኋላ “ተቋሙ” እየተባለ የሚጠራ) በኢትዩጰያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ህገ መንግስት አንቀፅ ፶፭(፩) እና (፲፭) በተደነገገው መሠረት የሕግ ሰውነት ያለው ሆኖ ራሱን ችሎ በዚህ አዋጅ እንደገና ተቋቁሟል፡

፪. የተቋሙ ዋና መሥሪያ ቤት አዲስ አበባ ሆኖ ጉባዔዉ በሚወስነው በማናቸውም ቦታ ቅርንጫፍጽ/ቤት ሊከፍት ይችላል፡፡

፮. ዓላማ

የተቋሙ ዓላማ በሕግ የተደነገጉ የሰዎች መብቶች እና ጥቅሞች በአስፈፃሚው አካላትመከበራቸውን በማረጋገጥ፣ የሕግ የበላይነትን መሠረት ያደረገ ጥራት፣ ቅልጥፍናና ግልጽነት ያለው መልካም የመንግሥት አስተዳደር እንዲሰፍን ማድረግ ይሆናል፡፡

፯. ስለ ተቋሙ ሥልጣንና ተግባር

ተቋሙ ተጠሪነቱ ለምክር ቤቱ ሆኖ የሚከተሉት ስልጣንና ተግባራት ይኖሩታል፡-

፩. አስፈፃሚ አካላት የሚያወጧቸው አስተዳደራዊ መመሪያዎች፣ የሚሰጧቸው ውሳኔዎችና  አሠራሮቻቸው ሕገ መንግስታዊ ድንጋጌዎች እንዲሁምሌሎች ህጎችን የማይቃረኑ መሆናቸውን የመቆጣጠር፤

፪.  የቀረቡለትን የአስተዳደር በደል አቤቱታዎች መሰረት በማድረግ ወይም በራስ ተነሳሽነት ወይም በአስፈላጊ ጉዳዮች ላይ ስልታዊ ምርመራ  የማካሂድ፤

፫. አስተዳደራዊ በደል መፈፀሙን ሲያረጋግጥ ተገቢዉን የመፍትሄ ሃሳብ የማቅረብ፤

፬. አስፈፃሚው አካል ሥራውን በህግ መሰረት የሚያከናውን መሆኑን ለማረጋገጥና አስተዳደራዊ በደሎች እንዳይፈፀሙ ለመከላከል ቁጥጥር የማድረግ፤

፭. አስተዳደራዊ በደሎች የሚቀረፉበትን ሁኔታ የማጥናትና ምክረ ሀሳብ የማቅረብ፤

፮.  የተሻለ የመንግስት አስተዳደርን ለማስገኘት ነባር ሕጎች ወይም አሰራሮች ወይም መመሪያዎች እንዲሻሻሉ፣አዳዲስ ሕጎች እንዲወጡ ወይም ፖሊሲዎች እንዲቀየሱ የማሳሰብ፤

፯.  በመልካም የመንግስት አስተዳደር ጉዳዩች ላይ ለመንግስት የምክር አገልግሎት የመስጠት፤

፰. ሕብረተሰቡ ስለመልካም አስተዳደር እና ስለ አስተዳደራዊ ፍትህ ግንዛቤ እንዲኖረው የተለየዩዘዴዎችን በመጠቀም ግንዛቤ የመፍጠር፤

፱.  በዓለም አቀፍ የመልካም አስተዳደር ጉዳዮች በሚመለከት ስብሰባዎች ኮንፍረንሶች ሲምፖዚየም ላይ መሳተፍ፣

፲. ዓላማዉን ለማስፈፀም የሚያስፈልጉ ሌሎች ተግባራትን የማከናወን

፰. የሥልጣን ገደብ

ተቋሙ የሚከተሉትን ጉዳዩች የመመርመር ሥልጣን የለዉም ፡-

፩. በሕዝብ ምርጫ የተቋቋሙ ምክር ቤቶች በሕግ አውጭነታቸው የሚሰጧቸው ውሳኔዎችን፤

፪. በፍርድ ቤቶች ወይም በህግ የመዳኘት ስልጣን በተሰጣቸው አካላት በመታየት ላይ ያሉ ጉዳዩች

ወይም የታዩና ውሳኔ የተሰጠባቸውጉዳዩችን ፤

፫.በፌደራል ዋና ኦዲተር ወይም በክልል ዋና ኦዲተር መስሪያ ቤት በመታየት ላይ ያሉ እና የመጨረሻ ውሳኔ ያገኙጉዳዮችን፤ወይም

፬.  በመከላከያ ሠራዊትና በፖሊስ ክፍሎች የሚሰጡ የፀጥታ ወይም የሀገር መከላከል ጉዳዮችን በሚመለከት የሚሰጡ ውሳኔዎችን ፡፡

ክፍል ሶስት

የተቋሙ አቋምና ሥልጣንና ተግባር

፱. የተቋሙ አቋም

ተቋሙ፡-

፭. የቅርንጫፍ ጽ/ቤት ዕንባ ጠባቂ እና

፮. ለሥራው አስፈላጊ የሆኑ ሠራተኞች ይሆናል፡፡

፲.የጉባዔ አባላት                       

፩.  የተቋሙ ዕንባ ጠባቂዎች ጉባዔ (ከዚህ በኋላ “ጉባዔ” እየተባለ የሚጠራ) በዚህ አዋጅ እንደገና ተቋቁሟል፣

፪.  ጉባዔው የሚከተሉት አባላት ይኖሩታል፡-

ሀ/ ዋና ዕንባ ጠባቂ …………………………………………ሰብሳቢ

ለ/  ምክትል ዋና ዕንባ ጠባቂ..…………………………… ምክትል ሰብሳቢ

፲፩.የጉባዔው ሥልጣንና ተግባር

ጉባዔው ከዚህ በታች የተዘረዘሩት ሥልጣንና ተግባርይኖሩታል፡-

፩. ይህን አዋጅ ሥራ ላይ  ለማዋል መመሪያዎችን እና የውስጥ ደንቦችን የማፅደቅ፣

፪.  በተቋሙ ረቂቅ በጀት ላይ የመምከር፣

፫.  የመንግስት ሠራተኞች ሕግ ቢኖርም ጉባኤዉ ፡-

ሀ. ለተቋሙ ስራ አመቺ የሆነ አደረጃጀትና መዋቅር አጥንቶ በስራ ላይ ያዉላል

ለ. ለተቋሙ ሠራተኞች ልዩ የደመወዝና ስኬል ስርዓት አጥንቶ ለምክር ቤት ያቀርባል፣ ሲፈቀድም ተግባራዊነቱን ይከታተላል፣

ሐ. የተቋሙ ሠራተኞች የሚተዳደሩበትን የአስተዳደር መመሪያ ያወጣል፣

መ. ለተቋሙ ሠራተኞች የጥቅማ ጥቅም ክፍያ አስመልክቶ ዉሳኔ ይሰጣል፡፡

፬. የተቋሙን ዳይሬክተሮች የመመደብ፤

፭.የዳይሬክተሮችን የዲሲፕሊን ጉዳይመርምሮ ዉሳኔ መስጠት፣

፮. የሚቀርቡለትን የሰራተኛ አስተዳደር ጉዳዮች ወይም አቤቱታዎች መርምሮ ውሳኔ የመስጠት፡

፲፪. የዋና ዕንባ ጠባቂው ሥልጣንና ተግባር

፩.  ዋናው ዕንባ ጠባቂ ተጠሪነቱ ለምክር ቤቱ ሆኖ የተቋሙ የበላይ ኃላፊ በመሆን በዚህ አዋጅ ለተቋሙ የተሰጠውን ሥልጣንና ተግባር በሥራ ላይ ያውላል፡፡

፪.   የዚህ አንቀጽ ንዑስ አንቀጽ ፩ አጠቃላይ አነጋገር እንደተጠበቀ ሆኖ ዋናው ዕንባ ጠባቂ፤

ሀ/ የተቋሙ ዕንባ ጠባቂዎች ጉባዔ በሚያጸድቀው መመሪያ መሠረት ሠራተኞችን ይቀጥራል ፣ ያስተዳድራል፤

ለ/ በተቋሙ ዕንባ ጠባቂዎች ጉባኤ የተመከረበት ረቂቅ በጀት አዘጋጅቶ በቀጥታ ለምክር ቤቱ ያቀርባል፣ ሲፈቀድም ሥራ ላይ ያውላል፤

ሐ/  በቂ ምክንያት ሲኖረው አንድ ጉዳይ ከአንድ የምርመራ ክፍል ወይም መርማሪ ወደ ሌላ የምርመራ ክፍል ወይም መርማሪ ያዛውራል፤ወይም በራሱ ይመረምራል፤

መ/  ተደጋጋሚ የአስተዳደር በደሎችን አጥንቶ ከመፍትሔ ሀሳብ ጋር ለምክር ቤቱ ያቀርባል፤

ሠ/አስተዳደራዊ ጉዳዩችን የሚመለከቱ ረቂቅ ህጎችን አዘጋጅቶያቀርባል፤በሌሎች አካላት በተዘጋጁ ላይ አስተያየት ይሰጣል፤

ረ/ አስተዳደራዊ በደሎችንና የተቋሙን የስራ አካሂድ አስመልክቶ ለምክር ቤቱ ሪፖርት ያቀርባል፤

ሰ/  ተቋሙን በመወከል በስብሰባዎች ይካፈላል፣ከፌደራሉና ከክልል መንግስታት አካላት እንዲሁም መንግስታዊ ካልሆኑ ድርጅቶች ጋር የስራ ግንኙነት ያደርጋል፤

ሸ/ ቅርንጫፍ  ጽ/ቤቶችንያደራጃል፣  ያስተባብራል፣   ይከታተላል፣ ይቆጣጠራል፤

ቀ/ በምክር ቤቱ የሚሠጡትን ሌሎች ተግባራት የማከናወን፣

፫.  ለተቋሙ የቀረበ አቤቱታ በአቤቱታ አቅራቢ ላይ የማይመለስ ወይም የማይተካ ጉዳት ያደርሳል ብሎ ዋና ዕንባ ጠባቂ ካመነ ምርመራ እስኪጠናቀቅ ድረስ የዕግድ ትዕዛዝ የመስጠት፤

፬. በዚህ አንቀጽ በንዑስ  አንቀጽ ፪ ፊደል ተራ (ለ፣ሠ፣ረ) እና በአንቀፅ ፵፪ ከተጠቀሱት በስተቀር ሌሎች ጉዳዮችን በሚመለከት ዋና ዕንባ ጠባቂው ለተቋሙ የሥራ ቅልጥፍና ባስፈለገ መጠን ሥልጣንና ተግባሩን በከፊል ለዕንባ ጠባቂዎች ወይም ለሌሎች ኃላፊዎች ወይም ሌሎች ሰራተኞች በውክልና ሊያስተላልፍ ይችላል፡፡

፲፫. የምክትል ዋና ዕንባ ጠባቂ ሥልጣንና ተግባር

፩. ተጠሪነቱ ለዋና ዕንባ ጠበቂ ሆኖየተቋሙን ተግባራት በማቀድ፣ በማደራጀት፣ በመምራት እና በማስተባበር ዋና ዕንባ ጠባቂውን የመርደት፣

፪. ዋና ዕንባ ጠባቂው በማይኖርበት ጊዜ ለዋና ዕንባ ጠባቂው የተሰጡትን ስራዎች የማከናወን፣

፫. በዋና ዕንባ ጠባቂው የሚሰጡትን ሌሎች ተግባራት የማከናወን፣

፲፬.የሴቶች፣የሕጻናት እና አካል ጉዳተኞች ዕንባ ጠባቂ ሥልጣንና ተግባር

፩. ተጠሪነቱ ለዋና ዕንባ ጠበቂ ሆኖሴቶችን፣ ሕፃናትን እና አካል ጉዳተኞችን የሚመለከቱ ተግባራትን በማቀድ፣በማደራጀት፣ በመምራት እና በማስተባበር ዋና ዕንባ ጠባቂውን የመርዳት፣

፪. በዋናው ዕንባ ጠባቂዉ የሚሰጡትን ሌሎች ተግባራትየማከናወን፡፡

፲፭.የቅርንጫፍ  ዕንባ ጠባቂ ሥልጣንና ተግባር

ዕንባ ጠባቂው ተጠሪነቱ ለዋና ዕንባ ጠበቂ ሆኖየቅርንጫፍ ፅህፈት ቤቱ የበላይ ኃላፊ በመሆን በዚህ አዋጅ በአንቀፅ ፭ (፪) በተቋቋመበት ስፍራ ውስጥ ለተቋሙ የተሰጠውን ስልጣንና ተግባር በስራ ላይ ከማዋል በተጨማሪ የሚከተሉት ስልጣንና ተግባሮች ይኖሩታል፡-

፩. የመንግስት አስተዳደር ሕጎች እና ሌሎች ሕጎች ደንቦችና መመሪያዎች መከበራቸውን የማረጋገጥ፣

፪. በቂ ምክንያት ሲኖረው አንድ የአስተዳደር ጉዳይ ከአንድ የምርመራ ክፍል ወይም ከአንድ መርማሪ ወደ ሌላ የማዛወር ወይም እራሱ ምርመራ የማካሄድ ፤

፫. አስተዳደራዊ በደሎችን በተመለከተ ለዋና ዕንባ ጠባቂ ዝርዝር ሪፖርት የማቅረብ፤እንዲሁም በተቋቋመበት ስፍራ ለሚገኝ ክልል ምክር ቤት በጽሁፍ የማሳወቅ፤

፬. ከመልካም አስተዳደር መርህ ጋር የማይጣጣሙ ህጎችና የአሰራር ልምዶች እንዲሻሻሉ ሐሳብ የማቅረብ፤

፭. በተቋሙ ዕንባ ጠባቂዎች ጉባዔ በሚወጣዉ መመሪያ መሰረት ቅርንጫፍ ጽህፈት ቤቱን የመምራት፣

፮. ለቅርንጫፍ ጽህፈት ቤቱ በተፈቀደው በጀት መሰረት ክፍያዎችን የመፈጸም፤

፯. ቅርንጫፍጽህፈት ቤቱንበመወከልከክልልመንግስትአካላትናበተቋቋመበትሥፍራውስጥከሚሰሩመንግስታዊካልሆኑድርጅቶችጋርየስራግንኙነትየማድረግ፤

፰. በዋና ዕንባ ጠባቂ የሚሰጡትን ሌሎች ተግባራት የማከናወን፡፡

ስለ ዕምባ ጠበቂዎች አሻሻምና መመዘኛዎች

፲፮. አሿሿም

፩.  የተቋሙ ተሿሚዎች በምክር ቤቱ ይሾማሉ፡፡

፪.  የተቋሙተሿሚዎች አሿሿም የሚከተለው የአመራረጥ ሥርዓት ይኖረዋል፡-

ሀ/  ተሿሚዎች በዚህ አዋጅ አንቀጽ ፲፯ መሰረት በሚቋቋመው የዕጩ አቅራቢ ኮሚቴ  ይመለመላሉ

ለ/   ዕጩዎቹም በኮሚቴው ሁለት ሶስተኛ  ድምፅ  የተደገፉ መሆን አለባቸው ፤

ሐ/  ዕጩዎቹ  በምክር ቤቱ  አፈ-ጉባዔ አማካኝነት ለምክር ቤቱ ቀርበው ድምጽ የሚሰጥባቸው ይሆናል ፤

መ/  የቀረቡት ዕጩዎች በምክር ቤቱ ሁለት ሶስተኛ  ድምፅ ሲደገፉ ይሾማሉ፡፡

፰.ለሹመት የሚያበቁ መመዘኛዎች

ከዚህ በታች የተመለከቱትን መመዘኛዎች የሚያሟላ ሰው የኢትዮጵያ ሕዝብ ዕንባ ጠባቂ ሆኖ ሊሾም ይችላል፡-

፩.  ዜግነቱ ኢትዮጵያዊ የሆነ

፪.  ለኢትዮጵያ ፌዴራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ መንግሥት ተገዥ የሆነ፤

፫. በህግ ወይም በአስተዳደር ወይም በተዛማጅ የትምህርት መስክ ከታወቀ ዩኒቨርስቲ ቢያንስ የመጀመሪያ ዲግሪ እና በዘርፉ በቂ የስራ ልምድ ያለው፤

፬. ከማንኛውም  የፖለቲካ ፓርቲ  ገለልተኛ የሆነ ፣

፭.  በታታሪነቱ፣ በታማኝነቱ እና በሥነ-ምግባሩ መልካም ስም ያተረፈ

፮. ከደንብ መተላለፍ ውጪ  በሌላ የወንጀል ጥፋት ተከሶ ያልተፈረደበት ፤

፯. ሥራውን ለመሥራት የሚያስችል  ጤንነት ያለው እና

፰. ዕድሜው ከ፴፭ ዓመት በላይ የሆነ ፡፡

፲፱.  የሥራ ዘመን

፩.የተሿሚዎች የስራ ዘመን ስድስት ዓመት ይሆናል፡፡

፪. በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተመለከተዉየስራ ዘመን ሲያበቃ ለአንድ ተጨማሪ ስድስት ዓመት ብቻ ሊሾሙ ይችላሉ፡፡

፳.የደመወዝ እና ጥቅማ ጥቅም ክፍያ

፩.የተሿሚ ደመወዝና ጥቅማ ጥቅም የመንግስት ተሿሚዎች ጥቅማ ጥቅም ለመወሰን በወጣው ሕግ መሰረት ይፈጸማል፡፡

፪.በአንቀጽ ፳፩ (፩) መሰረት ሹመቱ ቀሪ የተደረገበት ወይም ከኃላፊነት የተነሳ ተሿሚ እንደገና         ካልተሾመ በስተቀር ያገኙት የነበረው ደመወዝ እና ጥቅማ ጥቅም ተጠብቆ ለስድስት ወራት ያህል በሕግ አውጪ ፣በህግ አስፈጻሚ  ወይም በዳኝነት አካላት ውስጥ የኃላፊነት ቦታ አይሰጠውም፣

፳፩.ተሿሚው ከኃላፊነት የሚነሳበት ምክንያት

፩. አንድ ተሿሚ በሚከተሉት ምክንያቶችከኃላፊነት እንዲነሳ ወይም ሹመቱ ቀሪ እንዲሆን ሊደረግ ይችላል፡፡

ሀ/ ሥራውን በገዛ ፈቃዱ ለመልቀቅ ሲፈልግና አስቀድሞ የሦስት ወር ማስጠንቀቂያ  በጽሑፍ ሲሰጥ ፣ ወይም

ለ/ በህመም ምክንያት ሥራውን በሚገባ ለማከናወን የማይችል መሆኑ ሲረጋገጥ፣ ወይም

ሐ/  ሙስና መፈፀሙ ወይም ሕግን የሚጻረር ሌላ ድርጊት መፈጸሙ ሲረጋገጥ፣ ወይም

መ/ ግልጽ የሆነ የሥራ ችሎታ ማነስ መኖሩ ሲረጋገጥ ፣ወይም

ሠ/  የሥራ ዘመኑ ሲያበቃ ፡፡

፪. አንድ ተሿሚ በዚህ አንቀጽ ንዑስ አንቀጽ ፩ መሠረት ከኃላፊነት ከተነሳበት ወይም ሹመቱ  ቀሪ ከሆነበት ጊዜ አንስቶ ባሉት ሦስት ወራት ጊዜ ውስጥ በሌላ ተሿሚ መተካት ይኖርበታል፡፡

፳፪.ተሿሚው ከኃላፊነት የሚነሳበት ሥነ-ሥርዓት

፩. በዚህ አዋጅ አንቀጽ ፳፩ንዑስ አንቀጽ ፩ ከፊደል ተራ (ለ) እስከ (መ) በተዘረዘሩት ምክንያቶች ሹመቱ ቀሪ እንዲሆን የሚደረገው ጉዳዩ በአንቀጽ ፳፫ መሰረት በሚቋቋመው ልዩ አጣሪ ጉባኤ ከተመረመረ በኋላ ይሆናል፡፡

፪.  ምክር ቤቱ በልዩ አጣሪ ጉባዔው አብላጫ ድምጽ ተደግፎ የቀረበለት የውሳኔ ሀሳብ መርምሮ ሲያምንበት እና በሁለት ሶስተኛ ድምጽ ሲደግፈው ተሿሚው ከኃላፊነት እንዲነሳ ይደረጋል፡፡

፳፫. የልዩ አጣሪ ጉባዔው ጥንቅር

ልዩ አጣሪ ጉባኤው  የሚከተሉት አባላት ይኖሩታል ፡-

፩.  የምክር ቤቱ ምክትል አፈ ጉባኤ …………………………….  ሰብሳቢ፤

፪.  የፌዴሬሽን ምክር ቤት ምክትል አፈ ጉባኤ …………………   አባል፤

፫.  ከምክር ቤቱ አባላት መካከል የሚመረጡ ሦስት አባላት……. አባል፤

፬.  በምክር ቤቱ መቀመጫ ካላቸው ተፎካካሪ የፖለቲካ ፓርቲዎች በጋራ

ስምምነት የሚመረጥ አንድ የምክር ቤቱ አባል  ………………አባል ፤

፭. የፌዴራል ጠቅላይ ፍርድ ቤት ምክትል ኘሬዚዳንት …………… አባል፡፡

፳፬. በሌላ ሥራ መሰማራት ስለመከልከሉ

፩. ተሿሚው በሥራ ዘመኑ ክፍያን በሚያስገኝ በሌላ የመንግሥት ሆነ የግል ቅጥር ሥራ ላይ እንዲሰማራ አይፈቀድለትም ፡፡

፪. በዚህ አንቀጽ ንዑስ አንቀጽ ፩ የተመለከተው ቢኖርም ተሿሚው አስተዋጽኦ እንዲያደርግ የሚፈለግበት የተለየ የሙያ መስክ ከግምት ውሰጥ ገብቶ በምክር ቤቱ ሊፈቀድለት ይችላል፡፡

 

ክፍል አምስት

የአቤቱታ አቀራረብና የምርመራ ሥነ-ሥርዓት

፳፭.  አቤቱታ የማቅረብ መብት

፩. አቤቱታ የሚቀርበው መብቴ ተጥሶብኛል በሚል ሰው ወይምበሶስተኛ ወገን  ሊሆን ይችላል፡፡

፪. እንደተፈጸመው የአስተዳደር በደል ክብደት ተቋሙ የአመልካቹ ማንነት ሳይገልፅ የሚቀርቡለትን አቤቱታዎች ሊቀበል ይችላል፡፡

፫. ማንኛውም ሰው ለደረሰበት የአስተዳደር በደል ለተቋሙ አቤቱታ ከማቅረቡ በፊትአግባብነት ላላቸው አካላት ደረጃውን ጠብቆ ቅሬታውን የማቅረብ እና ዉሳኔ ማግኘት ወይም በተወሰነዉ የጊዜ ገደብ ዉስጥ ዉሳኔ ያላገኘ መሆን ይኖርበታል፡፡

፬. በአንቀጽ፰የተደነገገው እንደተጠበቀ ሆኖ በዚህ አዋጅ መሰረት አቤቱታ የማቅረብ መብት በጉዳዩ የወንጀል ወይም የፍትሐብሄር ክስ መመስረትን አይከለክልም፡፡

፭. ተቋሙ አቤቱታዎችን ተቀብሎ የሚመረምረው ያለምንም ክፍያ ነው፡፡

፳፮.ስለ አቤቱታ አቀራረብ

፩. አቤቱታ በቃል ወይም በጽሁፍ ወይም በማንኛውም ሌላ መንገድ ለተቋሙ ሊቀርብ ይችላል፡፡

፪. አቤቱታ በተቻለ መጠን ከደጋፊ ማስረጃዎች ጋር መቅረብ ይኖርበታል፡፡

፫. አቤቱታ እንደሁኔታው በፌዴራል ወይም በክልሉ የስራ ቋንቋ ሊቀርብ ይችላል፡፡

፳፯. ማስረጃዎች እንዲቀርቡስለማድረግ

ተቋሙ አስፈላጊ ማጣሪያዎችን ለማካሄድ በቂ በሆነ ጊዜ ውስጥ ፡-

፩.ተመርማሪዎች ለጥያቄ እንዲቀርቡ ወይም መልስ እንዲሰጡ ፣

፪. ምስክሮች ቀርበው ቃላቸውን እንዲሰጡ፣

፫. ለጉዳዩ ጠቃሚ የሆነ ማስረጃ የያዘ ማንኛውም ሰው ይህንን ማስረጃ እንዲያቀርብ፣

ለማድረግ ይችላል፡፡

፳፰. መፍትሔ ስለመስጠት

፩. ተቋሙ የቀረበለትን አቤቱታ በስምምነት ለመጨረስ የተቻለውን ሁሉ ማድርግ አለበት፡፡

፪. የምርመራውን ውጤት ከነመፍትሔ ሀሳቡ ለሚመለከተው አካል የበላይ ኃላፊ በጽሁፍ ያቀርባል፡፡

፫. ተቋሙ በዚህ አንቀጽ ንዑስ አንቀጽ ፪ መሰረት የሚሰጠው የመፍትሔ ሐሳብ ለተፈፀመው  አስተዳደር በደል ምክንያት የሆነው ድርጊት ወይም አሰራር እንዲቆም ወይም ለበደሉ  ምክንያት የሆነው መመሪያ ተፈፃሚነቱ ቀሪ እንዲሆንና የተፈፀመው የአስተዳደር በደል እንዲታረም ወይም ተገቢ የሆነ ማንኛውም ሌላ እርምጃ እንዲወሰድ በግልፅ የሚያመለክት መሆን ይኖርበታል፡፡

፬. ተቋሙ የምርመራ ዉጤት ለአቤቱታ አቅራቢዉ በጽሁፍ ማሳወቅ ይኖርበታል፡፡

፭.ለተቋሙ የሚቀርቡ አቤቱታዎች በአጭር ጊዜ ውስጥ ምላሽ ማግኘት ይኖርባቸዋል፡፡

፳፱.የአስፈጻሚ አካላት ግዴታ

፩. ተቋሙ አግባብነት ያላቸዉን ሰነዶች ወይም ማስረጃዎች እንዲቀርቡ ወይም መልስ እንዲሰጡ ሲጠየቁ የተጠየቀው አካል በተሟላ አኳኋን የማቅረብ ግዴታ አለበት፤

፪. አስፈጻሚ አካላትበተቋሙ በቀረበ የምርመራ ውጤትና የመፍትሄ ሀሳብ ላይ በ፴ ቀናት ውስጥ የእርምት እርምጃ የመውሰድ ግዴታ አለበት፣ የወሰዱትን ዕርምጃ እና ለመውሰድ ካልተቻለ በቂ ምክንያት ካላቸዉይህንኑ በመግለፅ ለሕዝብ ዕንባ ጠባቂ ተቋም በተጠቀሰው የጊዜ ገደብ ውስጥ የማሳወቅ ግዴታ አለባቸዉ፡፡

፴.ይግባኝ የማቅረብ መብት

፩. ማንኛውም አቤቱታ አቅራቢ ወይም አስፈጻሚ አካልየተቋሙ ኃላፊወይም መርማሪ በሰጠው የምርመራ ዉጤትና መፍትሔ ሀሳብ ወይም ዉሳኔላይ ቅሬታያለው ከሆነ የምርመራ ዉጤትና የመፍትሔ ሐሳብ ወይም ዉሳኔዉ በጽሁፍ ከደረሰው ጊዜ አንስቶ በ፴ ቀናት ውስጥ በደረጃው ቀጥሎ ለሚገኘው የተቋሙ ኃላፊ ወይም ዳይሬክተር ቅሬታውን የማቅረብ መብት አለው፡፡

፪. በዚህ አንቀጽ ንኡስ አንቀጽ (፩) መሰረት ቅሬታው የቀረበለት ተሿሚ ወይም ኃላፊ ወይም ዳይሬክተር የተሰጠውን የምርመራ ዉጤትና መፍትሔ ሐሳብ ወይም ዉሳኔ ማሻሻል፣ ማገድ፣ መሻር ወይም ማፅናት ይችላል፡፡

፫. ዋና ዕንባ ጠባቂው በ፴ ቀናት ውስጥ ውሳኔ መስጠት ይኖርበታል፤ የሚሰጠው ውሳኔምየመጨረሻ ይሆናል፡፡

፴፩. ቅጣት

፩.ማንኛውም ሰው፡-

ሀ/በተቋሙ መጥሪያ ደርሶት ወይም በሌላ ሁኔታ ተጠርቶ ካልቀረበ፣ ወይም

ለ/ ለምርመራ ወይም ለቁጥጥር ስራ ማስረጃዎችን ወይም ሰነዶችን እንዲያቀረብ ተጠይቆ ተቋሙ በጠየቀው የጊዜ ገደብ ውስጥ የማያቀርብ ፣ ወይም

ሐ/ የምርመራ ወይም የቁጥጥር ሥራ እንዳይሰራ እንቅፋት የሆነ፣ ወይም

መ/ ምስክሮች ወይም አቤቱታ አቅራቢዎች ወይም ለተቋሙ ሥራ በማናቸውም መንገድ በተባበሩ ወገኖች ላይ ጥቃት ያደረሰ ፣ ወይም

ሠ/ ያለ በቂ ምክንያት በተቋሙ በቀረበ የምርመራ ዉጤትና መፍትሄ ወይም የቁጥጥር ውጤትመሰረት የእርምት ዕርምጃ በ፴ ቀናት ውስጥ ያልወሰደ እንደሆነ ከአምስት ዓመት እስከ ሰባት ዓመት በሚደርስ እስራት ወይም ብር ሺ(አስር ሺ ብር) የገንዘብ መቀጮ ወይም በሁለቱም ይቀጣል፡፡

፪. በዚህ አንቀጽ ንዑስ አንቀጽ (፩) ከፊደል ተራ (ሀ) እስከ (ሠ) የተዘረዘሩትን ጥፋቶች የፈጸመ ማንኛውም ሰው በሕግ እንዲጠየቅ ተቋሙ በቀጥታ ጉዳዩ ለሚመለከተው ዓቃቤ-ሕግ መስሪያ ቤት የድርጊቱን ሪፖርት ከደጋፊ ማስረጃዎች ጋር ያቀርባል፡ ከተቋሙ ትዕዛዝ የደረሰው ዓቃቤ ህግ መስሪያ ቤት አግባብ ባለው ሕግ መሰረት የወንጀል ክስ ይመሰርታል፡፡

፴፪. የማሳወቅ ግዴታ

ተቋሙ የምርመራ ስራውን በሚያከናውንበት ጊዜ ወንጀል ስለመፈፀሙ ያመነ እንደሆነ ለሚመለከተው አካል ወይም ኃላፊ ወዲያውኑ በጽሁፍ የማሳወቅ ግዴታ አለበት፡፡

መወሰን ካልተቻለ አስቀድሞ የቀረበለት አካል ይመረምራል፡፡

፴፫.የስልጣን መደራረብ

፩.  በተቋሙና በኢትዮጵያ ሰብዓዊ መብት ኮሚሽን  ሥልጣን ሥር የሚወድቁ ጉዳዮች በሚያጋጥሙ ጊዜ በማንኛቸው እንደሚመረመሩ በሁለቱ የጋራ ምክክር ይወሰናል፡፡

፪. አንድን ጉዳይ የትኛው አካል እንደሚመረመር በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሰረት መወሰን ካልተቻለ አስቀድሞ የቀረበለት አካል ይመረምራል፡፡

፴፬.የመተባበር ግዴታ     

ተቋሙ ሥልጣንና ተግባሩን ሥራ ላይ ለማዋል እንዲችል ማንኛውም ሰው አስፈላጊውን ድጋፍ የመስጠትና የመተባበር ግዴታ አለበት፡፡

፴፭.መግለጫ ስለመስጠት

፩. ተቋሙ እንደአስፈላጊነቱ የምርመራ፣የቁጥጥር እና የጥናት ውጤቶችን አስመልክቶ በመገናኛ ብዙሀን ይፋዊ መግለጫ ይሰጣል፡፡

፪. ተቋሙ መደበኛ ሪፖርትን ለምክር ቤት የማቅረብና አሰራሩን በሙሉ ለህዝብ ግልፅ ማድረግ ይኖርበታል፡፡

፫. በተቋሙ የቀረበ የምርመራ ዉጤትና መፍትሄ ሀሳብ ለመፈፀም ተባባሪ ያልሆነ አስፈጻሚ አካላት ዝርዝር በተመለከተ ልዩ ሪፖርት ለምክር ቤቱ ማቅረብ፤ ምክር ቤቱም ተገቢዉን እርምጃ ይወሰዳል፡፡

፬. በዚህ አንቀፅ በንዑስ አንቀፅ (፩) ፣ (፪) እና (፫) የተደነገገው ቢኖርም የአገሪቱ የፀጥታና ደኅንነት አደጋ ላይ እንዳይወድቅ ለማድረግ ወይም የግለሰቦችን የግል ህይወት መብት ለመጠበቅ ሲባል በሚስጢር ሊያዙ በሚገባቸው ጉዳዩች ላይ ተቋሙ ጥንቃቄ የመውሰድ ግዴታ አለበት፡፡

፴፮. በስም ማጥፋት ስላለመጠየቅ

፩. በዚህ አዋጅ መሠረት የቀርበ አቤቱታ በስም ማጥፋት አያስጠይቅም፡፡

፪. ተቋሙ ስለሚያካሂደው ምርመራ ውጤት ለምክር ቤቱ የሚያቀርበው ሪፖርት ወይም በመገናኛ ብዙሃን በሚሰጠው ይፋዊ መግለጫ ወይም ሥራውን በማስመልከት በሚያደርገው ሌላ ዓይነት መፃፃፍ በስም ማጥፋት የሚያስጠይቅ አይሆንም፡፡

፴፯. ልዩ መብት   

ማንኛውም የተቋሙ፡-

፩.  ተሿሚ ከሆነ ምክር ቤቱ፣

፪.  መርማሪ ፣ ምርመራ ስራ የሚያከናውን ባለሙያ ወይም የምርመራ ዳይሬክቶሬት ከሆነ ዋና ዕንባ ጠባቂው  ሳይፈቅድ ወይም ከባድ ወንጀል ሲፈጽም እንጅ ከፍንጅ ካልተያዘ በስተቀር አይያዝም ፣አይከሰስም፣አይታሰርም ፡፡

፴፰.በጀት

፩.  የተቋሙ በጀት ከሚከተሉት ምንጮች የሚገኝይሆናል፡-

ሀ/  በምክር ቤቱ በሚመደብ በጀት ፣

ለ/  ከዕርዳታ፣ ከስጦታና ከማናቸውም ሌላ ምንጭ፡፡

፪.  ለተቋሙ ከተፈቀደው በጀት ውስጥ የየሦስት ወሩ ድርሻ የሆነ የሥራ ማስኬጃ በቅድሚያ በሕዝብ ዕንባ ጠባቂ ተቋም ስም በተከፈተው የባንክ ሂሳብ ውስጥ በአንድ ጊዜ እንዲቀመጥ ይደረጋል፡፡

፴፱. የሂሣብ መዛግብት

፩.  ተቋሙ የተሟላና ትክክለኛ የሆኑ የሂሣብ መዛግብት ይይዛል፡፡

፪.  የተቋሙ ሂሣብ ምክር ቤቱ በሚሰይመው አካል በየዓመቱ ይመረመራል፡፡

፵. ይግባኝ

፩. ጉባኤው በሚሰጠው የአስተዳደር ውሳኔ ቅር የተሰኘ የተቋሙ ዳይሬክተር ውሳኔው ከተሰጠበት ጊዜ አንስቶ በ፴ ቀናት ውስጥ የይግባኝ ቅሬታውን ለምክር ቤት አፈ ጉባኤ ማቅረብ ይችላል፡፡

፪. በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሰረት የምክር ቤቱ አፈ ጉባኤ የሚሰጠው ውሳኔ የመጨረሻ ይሆናል፡፡

፵፩. በሌሎች ባለሙያዎች ስለመገልገል

ተቋሙ ለተለየ ሥራና ለተወሰነ ጊዜ ተገቢ የሆነውን ክፍያ በመፈፀም ለሥራ የሚያስፈልጉትን  የራሱ ያልሆኑ ባለሙያዎችን መድቦ ሊያሠራ ይችላል፡፡

፵፪.ሚስጥር ስለመጠበቅ

በፍርድ ቤት ካልታዘዘ ወይም በዋና ዕንባ ጠባቂው ካልተፈቀደ በስተቀር ማንኛውም የተቋሙ ተሿሚ ወይም ሠራተኛ ወይም በአንቀጽ ፵፩ መሠረት የተመደበ ባለሙያ በሥራው አጋጣሚ ያወቀውን ምስጢር በማንኛውም ጊዜ የመጠበቅ ግዴታ አለበት፡፡

፵፫. ደንብና መመሪያ የማውጣት ሥልጣን              

፩.  ምክር ቤቱ ለዚህ አዋጅ አፈፃፀም አስፈላጊ የሆኑ ደንቦችን ሊያወጣ ይችላል፡፡

፪. ጉባኤዉ ለዚህ አዋጅ እና ደንቦች አፈፃፀም አስፈላጊ የሆኑ መመሪያዎችን ሊያወጣ ይችላል፡፡

፵፬. የመሸጋገሪያ ድንጋጌዎች

ይህ አዋጅ ከመውጣቱ በፊት በተቋሙ በምርመራ፣ በቁጥጥርና ጥናት ላይ የሚገኙ ጉዳዮች በቀድሞው ህግ መሠረት መታየታቸው ይቀጥላል፡፡

፵፭.የተሻሩና ተፈፃሚነት ስለማይኖረቸው ህጎች

፩.የህዝብ ዕንባ ጠባቂ ተቋምን ለመቋቋም የወጣው አዋጅ ቁጥር ፪፻፲፩/፲፱፻፺፪በዚህ አዋጅ ተሸሯል፡፡

፪. ከዚህ አዋጅ ጋር የሚቃረን ማንኛውም ሕግ ወይም የተለመደ አሰራር በዚህ አዋጅ ውስጥ በተጠቀሱ ጉዳዩች ላይ ተፈፃሚነት አይኖረውም፡፡

፵፮. አዋጁ የሚፀናበት ጊዜ

ይህ አዋጅ በፌዴራል ነጋሪት ጋዜጣ ታትሞ ከወጣበት ቀን ጀምሮ የፀና ይሆናል፡፡
